Immediate family members are family members who have a visa readily available to them.  The following are immediate family members:

  • Child of a United States Citizens
  • Spouse  of a United States Citizen
  • Parent of a United States Citizen

Preference Category Family Members


Family members that fall into a preference category are family members that may be petition but are subject to a waiting period due to backlogs.  The backlogs occur because there are limits in the number of visas that can be issued each year. The following are family members that fall into preference categories:

  • Unmarried Sons and daughters of United States Citizens
  • Married sons and daughters of United States Citizens
  • Sons and daughters of Legal Permanent Residents
  • Spouse of Legal Permanent Resident
  • Child of Legal Permanent Resident
